This Privacy Policy ("Policy") describes how BetterBite ("BetterBite," "we," "our," or "us"), collects, uses, discloses, and otherwise processes your personal information when you use our mobile application, our website at trybiteai.com, and any related products, features, and services (collectively, the "Services"), as well as your privacy rights and the choices you have regarding your personal information.
This Policy forms part of, and is incorporated into, our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service. Please read this Policy together with the Terms of Service. By using the Services, you acknowledge that you have read and understood this Policy.
We designed BetterBite to collect as little personal information as reasonably possible, to never sell your personal information, and to never use it for third-party or cross-context behavioral advertising.
The Services are intended for a general audience and are not directed to children. If you reside in the United States, you must be at least 13 years old to use the Services. If we learn that we have collected personal information from a child under 13 without the required consent, we will investigate and take steps to delete that information and the associated account. If you reside in the EEA, Switzerland, or the United Kingdom, you must be at least 16 years old to use the Services. Parents or guardians who believe their child has provided us with personal information may contact us at hello@trybiteai.com.
We collect personal information (a) directly from you, (b) automatically through your use of the Services, and (c) from certain third parties.
We do not use advertising identifiers, third-party advertising cookies, or cross-app/website tracking, and we do not build advertising profiles about you.
Our website uses a minimal set of technologies. We use only strictly necessary and functional technologies required to make the site work, keep it secure, remember basic preferences, and understand aggregate traffic. We do not use advertising or targeting cookies, and we do not use tracking technologies to serve you personalized ads or to share your information for cross-context behavioral advertising. You can control cookies through your browser settings; disabling some may affect how the site functions. Because we do not engage in tracking-based advertising, we honor recognized browser opt-out signals (such as Global Privacy Control) where required by law.
Where the GDPR or UK GDPR applies, we rely on the following legal bases:

We use a small number of providers to run BetterBite. They process information only to provide their service to us, under contract, and are not permitted to use it for their own purposes. They are:

When you scan a meal, barcode, label, menu, or your fridge, the image or text you are scanning is sent through our server to Anthropic, PBC, which operates the Claude AI models, acting as our processor to generate a nutrition estimate. That is the only third-party AI service BetterBite uses.
We ask for your explicit permission inside the app before anything is sent for AI analysis, and nothing is sent until you grant it. The in-app disclosure names what is sent, who receives it, and how long it is kept. You can withdraw that permission at any time in Settings; the rest of the app, including manual logging, your targets and your history, keeps working without it.
What is sent: only the photo or text you are scanning, and any food description you type. What is not sent: your name, email, account, weight, health data and device identifiers are never included, so Anthropic cannot identify whose scan it is. Anthropic is bound by terms requiring the same or equivalent protection of that data as this policy provides, does not use what we send to train its models, and does not retain it after the request is answered.
Separately, and only once you have granted AI analysis permission, we may retain copies of your scans and any corrections you make to train and improve our own food-recognition model. These copies are kept fully anonymized, with no name, account, email, or device identifier attached, so that they cannot be traced back to you. They are used only to improve the model, are never sold, are never used for advertising, and are never included in your account backups. We do not sell your personal information, and we do not share it for third-party or cross-context behavioral advertising. We disclose personal information only to the categories of recipients below and only as needed:
Parts of the Services let you publish content, such as a recipe, to a community area where other users can see it, together with the display name, handle, and profile photo you have chosen. Anything you publish there is visible to other users of the app, who may view, save, or report it. Please do not include anything in published content that you would not want to be public. You can delete content you have published; copies that others have already saved may persist. Publishing is always your choice, and nothing you log privately is published.
We may aggregate, de-identify, or anonymize information so that it no longer identifies you or is no longer considered personal information under applicable law. We may use and disclose such information for any lawful purpose, and we commit to maintaining it in de-identified form and not attempting to re-identify it except as permitted or required by law.
We maintain reasonable technical, organizational, and administrative safeguards designed to protect personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. For example, passwords are stored only as salted, one-way hashes, traffic is encrypted in transit, access to systems is limited, and our AI processing keeps sensitive keys server-side. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please keep your account credentials confidential and notify us promptly of any suspected unauthorized use.
We retain personal information for as long as necessary to provide the Services and fulfill the purposes described in this Policy, unless a longer period is required or permitted by law (for example, to comply with legal obligations, resolve disputes, or enforce our agreements). To determine retention periods, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes of processing, and applicable legal requirements. Meal photos are stored only on your device, in the app's own storage, and are never uploaded to our servers or included in your backup; deleting a meal deletes its photo, and deleting the app removes all of them. Your profile and logs live primarily on your device and are removed locally when you delete the app; if you have an account, you can delete it and your backed-up data at any time from within the app or by contacting us. De-identified and anonymized information may be retained in de-identified form.
BetterBite is based in the United States, and we and our service providers may process personal information in the United States and other countries. If you use the Services from outside the United States, your information may be transferred to, stored, and processed in the United States and other jurisdictions whose data-protection laws may differ from those in your country. Where required by law (including for transfers from the EEA, UK, or Switzerland), we implement appropriate safeguards, such as standard contractual clauses, and take steps to ensure your information receives an adequate level of protection. By using the Services, you understand your information may be transferred as described.
Depending on your state of residence (including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws), you may have some or all of the following rights, subject to legal exceptions:
You can do two of these yourself, immediately, without contacting us. In the app, open Profile → Privacy & data. Download a copy gives you a file containing your account details, your subscription status and everything in your log — profile, meals, nutrition history, goals and weight. Delete my account and data removes your account, your synced log and your backup, signs you out on every device, and cannot be undone.
To exercise your other rights, email hello@trybiteai.com and describe your request. We will verify your identity before responding and will respond within the timeframes required by applicable law. You may use an authorized agent where the law permits; we may require verification of the agent's authority.
The California Consumer Privacy Act, as amended, provides California residents with specific rights. Below are the categories of personal information we may collect, the sources, purposes, and whether the information is "sold" or "shared." We do not sell personal information, and we do not share it for cross-context behavioral advertising.

Sources of this information include you (directly and automatically) and the third parties described in Section 2.3. We use each category for the business purposes described in Section 4 and disclose it only as described in Section 7. California residents also have the "Shine the Light" right to request information about disclosures for third-party direct marketing; because we do not disclose personal information to third parties for their own direct marketing, this does not apply. To the extent the Washington My Health My Data Act (or a similar state law) applies, the "consumer health data" we collect includes the food, activity, and body-metric information you choose to log and any health information you provide (for example, in support requests or surveys), as described in Section 2. We collect it directly from you and from devices/apps you connect (such as Apple Health), and we use it to provide, personalize, secure, and improve the Services and to comply with law. We share it only with the service providers and for the purposes described in Section 7, and we do not sell it. Washington residents may access, delete, or withdraw consent to our processing of consumer health data, and may appeal a decision, by emailing hello@trybiteai.com.
For individuals in the EEA, UK, or Switzerland, BetterBite is the "controller" of your personal information. Our legal bases are described in Section 5. You have the right to: access your personal information; request rectification of inaccurate or incomplete data; request erasure; restrict or object to processing (including processing based on legitimate interests and processing for direct marketing); request data portability; and, where processing is based on consent, withdraw consent at any time. You also have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects, except as permitted by law. Where Canadian privacy laws apply, we collect, use, and disclose personal information with your consent (express or implied) except where otherwise permitted by law. You are generally not required to provide your personal information, but we may be unable to provide certain features if you decline. You have the right to access and to request correction of your personal information, and to complain to the relevant data-protection authority. Quebec residents may also have rights to data portability and to request that we cease disseminating or de-index certain personal information in the circumstances provided by law. The Services may link to or integrate with third-party websites, products, or services (for example, Sign in with Apple, Apple Health, and the App Store). This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review their privacy policies.
We may update this Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. When we make material changes, we will post the updated Policy here with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Services after the changes take effect means you accept the updated Policy.
